TERMS & CONDITIONS
1. Definitions
The following terms have specific meanings throughout these Terms & Conditions: “we,” “us,” and “our” refer to the services provided by Nah Lumina Collective. “You” or “your” refers to you personally, as well as your guests or party, whether potential or actual, collectively referred to as the client, guest, or party. “Website” refers to www.nahlumina.com.
2. Price
The retreat is all-inclusive except for transportation costs and any additional 1:1 bodywork sessions booked separately. Unless otherwise specified, the price does not include foreign departure taxes, security fees, port charges, park fees, customs, immigration, agricultural fees, passenger facility charges, or international transportation taxes. Also excluded are tips or gratuities to staff, visa fees, baggage and personal insurance, transport to and from airports or train stations, beverages and food not explicitly included in the course package, and all other personal expenses. Please ensure you carry sufficient local currency to cover these items. We reserve the right to amend prices at any time before full payment has been made. Once full payment is complete, your price is confirmed, and no surcharges will apply unless you request changes after booking.
3. Payment
To secure your booking, a deposit of USD 1,000 is required at the time of booking. The remaining balance must be paid at least 30 days before the retreat start date. Individual payment plans may be available upon request. We accept payments via credit/debit cards and bank transfers. Please note that credit/debit card payments incur a 3% processing fee.
4. Booking Confirmation
Upon receipt of your payment, you will receive an email confirming your payment within 24 hours. A follow-up email with detailed information about your booked program will be sent thereafter. Please review all confirmation emails carefully to ensure your booking details are accurate. If you notice any errors or omissions, contact us promptly so we can make the necessary corrections.
5. Cancellation Policy
Due to the financial commitments involved in hosting retreats, we are unable to offer refunds for cancellations.
6. Our Liability to You
Nah Lumina accepts no responsibility or liability for any accidents, injuries, or other incidents beyond our control, including but not limited to war, terrorism, civil unrest, industrial disputes, natural or nuclear disasters, fire, epidemics, pandemics, transport disruptions, closed or congested airports or ports, hurricanes, or severe weather conditions. If you have any complaints regarding our services, these must be submitted in writing via email within 28 days of your retreat departure date.
7. Circumstances Beyond Our Control
We shall not be held responsible or liable for any significant changes to your program or cancellations caused by circumstances beyond our control, nor for any losses or damages incurred as a result. Such circumstances include, but are not limited to, those listed in section 6 above.
8. Travel Insurance
It is essential and a condition of our contract that you and all members of your party maintain suitable and comprehensive travel insurance covering the entire duration of your trip. Given our cancellation policy and the risk of losing your deposit, we strongly recommend you purchase insurance covering cancellations for any reason, injuries, lost luggage, force majeure, or any other risks affecting your booking. You may obtain insurance from any provider of your choice. Your decision to purchase travel insurance is solely your responsibility, and you acknowledge that insurance is your exclusive remedy for recovering non-refundable payments made to Nah Lumina. In some cases, we may require proof of insurance before confirming your booking. Failure to comply may result in refusal or revocation of your booking. Even if not requested, you remain fully responsible for having adequate coverage.
9. Health and Safety
We ensure that the health and safety standards applied meet or exceed local requirements at the retreat venue, and we follow WHO recommendations related to COVID-19.
Our retreats include Psychedelic Breath ®. Participation involves acknowledging and accepting the following: Breathwork may cause intense physical and emotional release and is not recommended for individuals with cardiovascular conditions (including angina, heart attack, high blood pressure, use of pacemakers), glaucoma, retinal detachment, osteoporosis, recent injuries or surgeries, mental illness, seizure disorders, those on major medications, or with personal or family history of aneurysms. Pregnant women should consult their primary care physician before participating. Those with asthma should bring an inhaler and consult both their physician and the Breathwork facilitator. Breathwork is experiential and may involve emotional intensity and energetic release. Participation under the influence of alcohol or drugs is not permitted.
You agree to follow all guidance and safety instructions during the Activities. Should you notice any hazard, you must immediately stop participating and notify staff. If your health does not permit participation, you acknowledge that you should not take part. Pregnant or post-natal participants must have their doctor’s full approval prior to participation.
10. Special Requests and Medical Conditions
Please advise us of any special requests or dietary requirements at the time of booking. While we will do our best to accommodate these, we cannot guarantee fulfillment. Any requirements should be communicated upon arrival. You are responsible for notifying us of any medical conditions that may affect your ability to participate. You must also inform retreat staff prior to any activities or treatments. No refunds will be issued if activities are canceled due to health or safety concerns. We reiterate the importance of purchasing travel insurance.
11. Passports, Visas, and Health Requirements
You are responsible for ensuring that you hold the correct passport, visa, and health documents required for travel and participation. Requirements may change without notice, so please verify before travel. We accept no liability for issues arising from failure to comply. If you lack required travel documents, it will be considered a no-show.
12. Your Behavior
You accept full liability for any damage or loss caused by you or your guests during your booking. We are not responsible for consequential losses suffered by third parties due to your actions. Unacceptable behavior may lead to immediate termination of your booking without refund.
13. Your Responsibility
You and your party are responsible for your conduct. If your actions pose danger, annoyance, or upset to others, we reserve the right to terminate your participation immediately without compensation or refund.
14. Complaints
If you have any concerns during your retreat, please notify Laura Garnweidner or Osvaldo Cañez immediately so that we can address the issue. Failure to do so may affect any subsequent claims. Formal complaints must be sent by email to Laura@nahlumina.com and buenavibra@osvaldocanez.com within 28 days of the retreat’s conclusion.
15. Collection and Use of Personal Information
We collect personal information when you contact us, make bookings, or register via online forms, social media, newsletters, surveys, or competitions, always with your express consent. Data provided is treated in accordance with applicable data protection regulations including Regulation (EU) 2016/679 (GDPR) and local privacy laws. We do not share your information with third parties not involved in fulfilling your booking, nor do we partner with advertising services.
16. Governing Law and Jurisdiction
For all legal relations between you and Nah Lumina Collective LLC shall be governed by the laws applicable at the registered seat of the retreat hosts.
